TERMS OF SERVICE
1. Acceptance of Terms
By downloading, installing, or using the Nudge mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
We may update these Terms from time to time. Your continued use of the App after any changes constitutes acceptance of the new Terms. We will notify you of significant changes through the App or via email.
2. Description of Service
Nudge is a social accountability application that enables users to:
- Create and join accountability challenges with other users
- Define daily rules and habits to track
- Log daily progress toward personal goals
- Set consequences (monetary fines or custom punishments) for missed commitments
- Connect with friends and share progress
- Receive notifications and reminders
3. Account Registration
To use Nudge, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Immediately notify us of any unauthorized use of your account
- Be responsible for all activities that occur under your account
You must be at least 13 years old to use Nudge. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
4. User Conduct
You agree to use Nudge only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App to harass, abuse, or harm other users
- Upload content that is illegal, offensive, defamatory, or infringes on others' rights
- Impersonate any person or entity
- Attempt to circumvent any security features
- Use automated means to access the App without permission
- Share your account credentials with others
- Create multiple accounts to evade restrictions
5. User Content
You retain ownership of content you submit to Nudge, including photos, logs, and messages ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App to provide our services.
You are solely responsible for your User Content and represent that you have all necessary rights to share it. We may remove any content that violates these Terms or is otherwise objectionable.
6. Challenges and Punishments
Challenges and punishments are created and managed by users. Nudge provides the platform but does not enforce or guarantee any punishment arrangements between users.
Important: Monetary fines are arranged directly between users through third-party services (such as Venmo). Nudge does not process, hold, or guarantee any payments. You participate in challenges and agree to punishments at your own risk and discretion.
- Custom punishments are agreements between challenge participants. Nudge is not responsible for ensuring punishments are completed or appropriate.
- Challenge administrators are responsible for fairly reviewing and approving punishment settlements.
- Abuse of admin privileges may result in account suspension.
7. Third-Party Services
Nudge integrates with third-party services including:
- Authentication providers (Apple, Google) for account login
- Payment services (Venmo) for fine payments between users
- Push notification services
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of third-party services.
8. Intellectual Property
The Nudge app, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, or reverse-engineer any part of the App without our written permission.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
We are not responsible for any interactions, disputes, or arrangements between users, including punishment agreements, payment disputes, or personal conflicts arising from challenge participation.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:
- Loss of data or content
- Financial losses from challenge punishments
- Disputes with other users
- Service interruptions or technical issues
Our total liability for any claims related to the App shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.
12. Account Termination
You may delete your account at any time through the App settings. We may suspend or terminate your account if you violate these Terms or engage in conduct we deem harmful to other users or our services.
Upon termination, your right to use the App ceases immediately. We may retain certain information as required by law or for legitimate business purposes.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in California.
14. Changes to the App
We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. We shall not be liable for any modification, suspension, or discontinuation of the App or any features.
